Liability Waiver and Release Agreement

[email protected] Liability Waiver and Release Agreement (“Agreement”) is entered into by the undersigned participant/guest (“Participant”) in favor of The Burland, its owners, officers, employees, agents, contractors, and affiliates (collectively, “The Burland”).
# 1) Acknowledgment of Risk
I understand that staying at, using, or participating in activities at The Burland, including but not limited to overnight stays, use of common areas, recreational activities, cooking and kitchen use, stairs and elevated surfaces, outdoor grounds, parking areas, and any family/reunion events, involves inherent risks. These risks may include minor injuries, slips, trips, falls, property damage, illness, exposure to allergens, and other unforeseen events. I acknowledge that these risks may arise from my own actions or inactions, the actions or inactions of others, the condition of the premises, or the use of equipment and facilities.
# 2) Assumption of Responsibility
I voluntarily assume full responsibility for any risks of injury, illness, loss, or damage to myself or my property that may occur in connection with my presence at or use of The Burland’s facilities. I agree to act responsibly, follow posted rules and staff instructions, supervise any minors in my care, and use the facilities and equipment only for their intended purposes.
# 3) Release of Liability
To the fullest extent permitted by Idaho law, I hereby release, waive, discharge, and covenant not to sue The Burland for any and all claims, demands, actions, damages, costs, or causes of action arising out of or related to any loss, damage, injury, or illness I may sustain while on the premises or participating in activities, whether caused by ordinary negligence of The Burland or otherwise.
This release does not apply to claims resulting from The Burland’s gross negligence, willful misconduct, or where otherwise prohibited by law.
# 4) Indemnification and Hold Harmless
I agree to indemnify, defend, and hold harmless The Burland from any claims, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of my presence on the premises, my conduct, or the conduct of minors under my supervision.
# 5) Medical Authorization
In the event of injury or illness, I authorize The Burland to seek emergency medical care for me or minors under my supervision. I am responsible for all associated costs.
# 6) Property and Personal Belongings
I am responsible for safeguarding my personal property. The Burland is not responsible for loss, theft, or damage to personal items brought onto the premises.
# 7) Rules, Alcohol, and Conduct
I will comply with all posted rules and applicable laws. If alcohol is permitted, I will consume responsibly and ensure no service to minors. The Burland may remove any person whose behavior creates a safety risk or disrupts others, without refund.
# 8) Photos and Recordings (Optional)
I grant The Burland permission to use non-identifying photos or recordings taken during events for marketing purposes. I may withdraw consent in writing at any time.
# 9) Severability
If any portion of this Agreement is found invalid or unenforceable, the remaining provisions shall continue in full force to the maximum extent permitted by law.
# 10) Governing Law and Venue
This Agreement is governed by the laws of the State of Idaho. Any dispute shall be brought in the state courts located in Fremont County, Idaho, unless otherwise required by law.
# 11) Entire Agreement
This Agreement constitutes the entire understanding regarding its subject matter and supersedes any prior discussions. I have read this Agreement, understand its terms, and sign it voluntarily.
